These Terms of Service ("Terms") govern your access to and use of the website located at pbgai.net and the AI phone receptionist services provided by Palm Beach Gardens AI LLC ("PBGAI," "we," "us," or "our"). By accessing our website, submitting a form, or using our services, you agree to be bound by these Terms. If you do not agree, do not use our website or services.

1. Description of Services

PBGAI provides AI-powered phone receptionist services for local service businesses. Our platform includes AI voice agents that answer inbound calls, qualify leads, book appointments, send call summaries, and perform related front-desk functions. Services are offered in three subscription tiers and are configured and managed by PBGAI on behalf of the customer.

SMS Notifications: As part of the PBGAI service, designated staff contacts at client businesses may receive automated SMS call summaries after each AI-handled call. Message frequency varies based on call volume — typically 1–10 messages per day per client account. Msg & data rates may apply. To opt out of SMS notifications at any time, reply STOP to any message. 2. Free Trial

PBGAI offers a two-week free trial for new customers. During the trial period:

• Your AI agent goes fully live — answering real calls, booking real appointments, and sending real summaries.
• No credit card is required to start the trial.
• A one-time setup fee of $499 is due upon conversion to a paid subscription, not during the trial.
• You may discontinue service at any time during the trial with no charge.
• PBGAI reserves the right to modify or discontinue trial eligibility at any time.

3. Subscription and Billing

Following the free trial, PBGAI services are billed on a monthly subscription basis. Current plan pricing is listed on our website and subject to change with 30 days' notice.

• Setup Fee: A one-time, non-refundable setup fee of $499 is charged upon subscribing to any paid plan. This fee covers full system configuration and onboarding.
• Monthly Plans: All plans are month-to-month. No annual contract is required unless you opt into an annual discount plan.
• Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No partial-month refunds are provided.
• Refunds: Monthly subscription fees are non-refundable once a billing period has begun. The setup fee is non-refundable under all circumstances.

4. Call Recording

By using PBGAI services, you acknowledge and agree that:

• All calls handled by your AI receptionist may be recorded.
• Callers are notified at the start of each call that the call may be recorded.
• Call recordings and transcripts are stored on PBGAI servers and made available to you through your customer portal.
• You are solely responsible for ensuring your use of call recordings complies with all applicable federal, state, and local laws, including laws governing notice and consent to recording in your jurisdiction.

5. No Guarantee of Outcomes

PBGAI does not guarantee any specific business outcomes from the use of its AI receptionist services.

While our platform is designed to help you capture leads, book appointments, and manage inbound calls, results will vary depending on your industry, call volume, market conditions, and many other factors outside our control. PBGAI makes no warranty, express or implied, that use of our services will result in increased revenue, bookings, or customer acquisition.

6. Acceptable Use

You agree not to use PBGAI services to:

• Violate any applicable federal, state, or local law or regulation
• Make or facilitate calls that violate the Telephone Consumer Protection Act (TCPA) or any other telecommunications law
• Harass, threaten, or defraud any individual
• Impersonate any person or entity in a deceptive or harmful manner
• Transmit any content that is unlawful, defamatory, obscene, or invasive of another's privacy
• Attempt to reverse-engineer, copy, or replicate PBGAI's platform or AI configuration

PBGAI reserves the right to suspend or terminate your account immediately if we determine, in our sole discretion, that you are using the platform in violation of these Terms or applicable law.

7. Customer Responsibilities

As a PBGAI customer, you are responsible for:

• Providing accurate business information during onboarding so that your AI agent can be properly configured
• Notifying PBGAI promptly of any changes to your business hours, services, pricing, or staff
• Ensuring that your use of AI-handled calls complies with all applicable laws in your jurisdiction
• Maintaining the confidentiality of any PIN or access credentials provided for your Office Manager agent
• Reviewing call recordings and summaries as needed to verify service quality

8. Intellectual Property

All content on pbgai.net — including text, graphics, logos, and AI configuration methodologies — is the property of Palm Beach Gardens AI LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any content from this website without prior written permission.

9. Limitation of Liability

To the fullest extent permitted by applicable law, PBGAI, its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, or lost business opportunities — arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount paid by you to PBGAI in the three months preceding the claim.

10. Disclaimer of Warranties

PBGAI services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

11. Indemnification

You agree to indemnify, defend, and hold harmless Palm Beach Gardens AI LLC and its officers, employees, and contractors from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any applicable law.

12. Termination

Either party may terminate the service relationship at any time. You may cancel by contacting us at sales@pbgai.net. PBGAI may terminate or suspend your access immediately, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the services ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will revise the effective date at the top of this page. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
